Plaintiffs claiming that homeowners were owed $53 million in surplus money from sheriff’s sales cannot initiate a class action against the state’s Treasury Department, the Commonwealth Court has ruled.

A three-judge panel in In re Sheriff’s Excess Proceeds Litigation on July 31 affirmed a Philadelphia Court of Common Pleas judge’s decision to deny class certification to the plaintiffs Joseph O’Hara and Finn Land Corp.
