In three recent cases, Pennsylvania courts made significant decisions that affect severed subsurface property rights, foreclosure counsel and municipal liens.

Severance of Oil and Gas Rights May Be Invalid

In Herder Spring Hunting Club v. Keller, 2014 PA Super 100 (2014), a Pennsylvania property owner’s failure to report to the county in 1894 that he had severed the oil and gas rights from the surface land of his estate resulted in the recent loss of oil and gas rights for his heirs.
