The NCAA has moved to dismiss its challenge to a state law mandating that the $60 million consent decree it levied against Penn State University following the Jerry Sandusky sex-abuse scandal must be paid into a state endowment fund.

In a motion to dismiss the case, Corman v. National Collegiate Athletic Association, filed Sept. 5, the National Collegiate Athletic Association said it had advised Penn State that payment of the $60 million fine under the terms of the Pennsylvania Institution of Higher Education Monetary Penalty Endowment Act would satisfy the requirements of the sanction, and that compliance with the act would render the litigation moot.
