All three judges on the appellate panel summoned by objectors to the settlement in the NFL concussion case wanted to know why their review had been sought at this point—before the trial judge has held the fairness hearing scheduled for November.
The U.S. Court of Appeals for the Third Circuit panel heard arguments Wednesday afternoon, about two months after U.S. District Judge Anita Brody of the Eastern District of Pennsylvania granted preliminary approval to a settlement between the National Football League and the former players who suffered head injuries while they played for the league.
