A Centre County judge said he will allow to proceed the lawsuit by the estate of Joe Paterno against the NCAA, but with 16 former plaintiffs stripped from the case.

On Sept. 11, Judge John B. Leete ruled in Paterno v. National Collegiate Athletic Association that the Paterno estate, Jay Paterno, Al Clemens, a member of Penn State University’s board of trustees, and former football coach William Kenney had pleaded enough facts to go forward with tortious interference and defamation claims. However, Leete said 16 additional plaintiffs, including ex-Penn State board members, faculty members and football players, failed to support their claims for civil conspiracy.
