A federal judge has remanded a case originally brought under the Family and Medical Leave Act and the Americans with Disabilities Act to state court.
Although the defendant, Cadmus Investments LLC, had argued that the plaintiff, a former employee, had dropped those claims in an effort to get the case sent back to the state court where she first filed, U.S. District Judge Edward G. Smith of the Eastern District of Pennsylvania wasn’t convinced that interpretation would outweigh other reasons for sending the case back to state court.
