A claim of fraud in a $40 million business dispute brought by a pipeline contractor against a natural gas company has survived a motion to dismiss in federal court along with a claim for punitive damages.
U.S. District Judge Robert D. Mariani of the Middle District of Pennsylvania tossed most of the claims brought by STI Oilfield Services against two energy companies, Appalachia Midstream Services and Chesapeake Energy Corp., along with their subsidiaries. Although the two companies are treated as distinct entities, they are represented by the same lawyers.
