A Philadelphia judge has let the owners of a nightclub and a parking lot out as defendants in the case of a man who was struck and killed by a vehicle while crossing the street from the nightclub to get to his parked car.

Philadelphia Court of Common Pleas Judge Marlene F. Lachman issued an opinion in response to plaintiff Donald Newell’s appeal of her decision to dismiss the owners of the Montana West nightclub and bar and DHL Machine Co., a business across the street where nightclub patrons were allowed to park, from the wrongful-death case.
