A trial judge has ruled an arbitration agreement a Reading, Pa., nursing home made a resident’s family sign was unconscionable because it was so one-sided and violated public policy.
Berks County Court of Common Pleas Judge Jeffrey Sprecher was critical of several provisions of the arbitration agreement produced by Manor Care in Hendricks v. Manor Care, calling some “misleading” and others “overreaching.”
