Where the burden falls for investigating the fitness of arbitrators could determine the outcome of a multimillion-dollar suit against investment bank Goldman Sachs.

The U.S. Court of Appeals for the Third Circuit weighed that question Tuesday morning when it heard arguments in the case originally brought by Athena Venture Partners, which went to arbitration in 2009 after its $5 million investment with Goldman Sachs went bad the year before.
