A concrete company hit with a $2.3 million judgment after a man was knocked into an open basement by an out-of-control hose attached to a concrete truck is appealing the verdict.
Defendant Trans-Fleet Concrete Inc. claimed on appeal that it was improperly held liable as the principal of a nonparty agent, 5 Star Concrete Pumping, which was the owner of the concrete truck. Additionally, Trans-Fleet claimed the plaintiffs failed to sufficiently argue the two companies were related.
