The state Supreme Court has denied the NCAA’s bid to have the justices strike down a Commonwealth Court ruling that questioned the validity of the $60 million consent decree the athletic body levied against Penn State University.
The justices on Wednesday denied the National Collegiate Athletic Association’s writ of prohibition in NCAA v. Commonwealth Court of Pennsylvania, with Justice Max Baer issuing a concurring opinion. The decision leaves the underlying case, which appeared to be on its way toward a resolution, back on track for trial next month.
