District courts have split in three directions on how to apply the exemption to the Fair Labor Standards Act for computer professionals and, now, the Western District of Pennsylvania has weighed in.

Taking the middle road, U.S. District Judge Terrence F. McVerry held that the exemption specifically for computer professionals can be yoked to the standard exemption for professionals. The effect of that decision is that the exception can apply to both salaried and hourly workers.
