Retired Philadelphia Court of Common Pleas Judge Willis W. Berry Jr. has decided not to take a plea deal regarding the theft and conflict of interest charges he faces for allegedly using his judicial positions and public money to help run his personal real-estate business.

Berry was expected to formally accept the deal in the Philadelphia Court of Common Pleas on Thursday, but his attorney, Samuel C. Stretton, announced that Berry will not be taking the plea offer because it may have affected his ability to collect a pension. A pretrial date has been set for Jan. 7.
