Is it unethical for an appellate judge in an opinion to severely criticize a jury verdict, particularly suggesting the jury condoned misconduct?
It is absolutely wrong for an appellate judge to make such a statement, particularly if the criminal case wasn’t before the judge. Such comments are really immature in nature, mean-spirited, and in many ways undermine the hard work of any jury hearing the case. This has the potential for tainting the entire experience of those jurors.
