In light of the state Supreme Court’s 2013 ruling that a police officer’s PTSD stemming from a fatal car collision was a compensable injury, the Commonwealth Court has changed its position on whether an armed robbery at a liquor store constitutes a normal working condition for workers’ compensation purposes.
On Dec. 30, an en banc panel of the Commonwealth Court reversed its prior decision in Pennsylvania Liquor Control Board v. Workers’ Compensation Appeal Board (Kochanowicz), and determined that a liquor store manager, who suffered from post-traumatic stress disorder after being robbed at gunpoint and duct-taped to a chair, should be awarded benefits for his mental injury.
