The Commonwealth Court in late January shut down the Philadelphia School Reform Commission’s bid to establish its authority to cancel expired collective bargaining agreements with the teacher’s union as negotiations proceed.

The ruling in Philadelphia Federation of Teachers v. School District of Philadelphia, in which a five-judge panel of the court determined that the relevant statutes did not give the commission the power to unilaterally cancel the expired agreement over disputed employee benefits before the negotiating reached an impasse, weighed into an area of law that has a “lack of statutory authority,” according to Judge Patricia A. McCullough, who wrote the unanimous opinion.
