Unsuccessfully challenging an oil and gas lease should not extend the terms of the lease for the duration of the litigation, the state Supreme Court has ruled.

In an issue of first impression that the U.S. Court of Appeals for the Third Circuit posed to the Supreme Court, the justices unanimously held that the terms of an oil and gas lease should not be equitably extended because the landowners sued the oil and gas company over the terms of the lease. The court issued the decision in Harrison v. Cabot Oil & Gas on Feb. 17.
