The case of a man who developed complications from having a surgical tube left inside of him years after an operation can proceed after initially being dismissed, the state Superior Court has ruled.

A three-judge panel in Gorman v. Aria Health System reversed the trial court’s grant of summary judgment in favor of the defendants. Plaintiff John Gorman initiated the suit, later continued by the executor of his estate, against Aria Health System and Dr. Brian P. Priest, the surgeon who operated on the plaintiff.
