A police officer who was allegedly assaulted by a patron while responding to a call at a drinking establishment may not sue the business for negligence and Dram Shop Act liability, the state Superior Court has ruled.
The court decided April 10 that the complaint of Philadelphia police officer Christopher Juszczyszyn against Lid’s Lounge was correctly dismissed at the trial court level. A three-judge panel agreed that any negligence that occurred because of the bar’s decision to serve alcohol to an intoxicated patron did not result in liability, and that the officer did not fall into the class of citizens protected by the Dram Shop Act.
