State rules aimed at reducing the chances defendants will be incarcerated for failure to post collateral for minor offenses are set to go into effect this summer.

The state Supreme Court approved amendments to numerous rules in the Pennsylvania Rules of Criminal Procedure that mandate magisterial district judges to prefer release on recognizance for defendants facing payment determination hearings, or trial for summary violations. The rules additionally place a greater emphasis on economic considerations when magisterial district judges decides to set collateral in payment hearings, or cases involving summary offenses.
