The Contractor and Subcontractor Payment Act does not apply to construction projects where the project owner is a government entity, the state Supreme Court has ruled in a unanimous decision.

In an opinion filed June 15, the court said the application of CASPA pivots on the definition of the term “owner,” which should not include government entities. The court accepted certification from the U.S. Court of Appeals for the Third Circuit to address the issue.
