Citing the rapid advance of technology, a smartphone and computer repair company will not be able to enforce a noncompete agreement against a former employee, a court of common pleas judge has ruled.
Lackawanna County Court of Common Pleas Judge Carmen D. Minora last month denied an electronics repair company’s request for a permanent injunction against a former employee. The plaintiff in iDropped v. Summo had sought to enforce the terms of a noncompete agreement that barred the former employee from working at similar repair companies for a period of five years and within a 100-mile radius of Scranton.
