Although there are some unresolved issues over an $18.5 million judgment against Safeway and Genuardi’s Family Markets, the state Supreme Court’s recent decision to deny allocatur is expected to effectively end more than 12 years of litigation in the case.
On June 24, the justices denied an appeal in Newman Development Group of Pottstown v. Genuardi’s Family Markets. The defendants had sought to reduce the multimillion-dollar judgment to present value; however, the denial affirmed an en banc panel of the state Superior Court’s decision that the judgment did not need to be reduced.
