Is it ethical for lawyers to use email with clients?
It is currently ethical to use email as long as the lawyer can protect the confidentiality of any emails involving clients. The Rules of Professional Conduct had been updated to require lawyers to have the competence and understanding of modern communication technology to ensure that confidentiality is protected. Rule 1.1, involving competence, has added Comment 8, which states as follows:
