The state Supreme Court has agreed to address a question that could intensify the consequences for government agencies that fail to pay contractors.

The justices granted allocatur June 25 in A. Scott Enterprises v. City of Allentown. They agreed to consider whether “a jury finding of bad faith require[s] the trial court to impose a statutory penalty and award attorney fees.”
