A silo manufacturer brought in as a third party in a breach of warranty case was denied its request for sanctions against the company that brought it into the litigation.

While U.S. Magistrate Judge Martin C. Carlson of the Middle District of Pennsylvania said silo manufacturer Jenike & Johanson (referred to as J&J by the court) was making good on its promise to go after StorCon Systems Inc., also a silo manufacturer, for sanctions relating to StorCon bringing J&J into the litigation, he said StorCon was well within its rights to bring the third-party action.
