Effective July 1, a minor child’s Social Security derivative benefits will be handled differently by the child-support guidelines. The changes to Pennsylvania Rules of Civil Procedure 1910.16-2 and 1910.16-4 were announced by the Pennsylvania Supreme Court on April 29.
Prior to July 1, a child’s Social Security derivative benefit was usually added to the total income of the parties and then subtracted from the basic support obligation prior to distributing the obligation between the parents. The exception was when the derivative benefit was received by the obligor, and then it was included in the obligor’s income only and not subtracted from the obligation.
