Does it violate the nepotism provisions of the new Code of Judicial Conduct for a judicial officer to use a relative who is an elected constable and was elected in their jurisdiction?

The new codes of conduct for judges and for district judges both have provisions that prohibit nepotism. In the new Rules Governing Standards of Conduct of Magisterial District Judges, Rule 2.13, on administrative appointments, says that a district judge has to exercise the power of appointment impartially and on the basis of merit. Subsection (2) says judges “shall avoid nepotism, favoritism and unnecessary appointments.”
