The state Superior Court has allowed a construction company to proceed with its negligent-misrepresentation case against an architectural firm for allegedly providing inadequate design plans.
In so ruling, a unanimous three-judge panel said the construction company did not need to make an explicit misrepresentation before it could recover in the case. The ruling in Gongloff Contracting v. L. Robert Kimball & Associates, Architects and Engineers, which was issued July 8, reversed a court of common pleas decision to toss the construction company’s claims.
