A Lackawanna County Court of Common Pleas judge has granted a new trial in a medical negligence case over an expert report that was excluded from the case, but referenced in testimony.

Judge Carmen D. Minora granted the plaintiffs’ motion for a new trial in Carlitz v. Delta Medix, in which a jury in May ruled in favor of defendant Jeffrey Guse. But the judge did not agree with the plaintiffs’ contention that certain jury members should have been stricken for cause.
