A Philadelphia judge has allowed a lawsuit against the city involving a child’s death at a swimming pool to move forward, despite the city’s argument that it has governmental immunity.

Philadelphia Court of Common Pleas Judge Frederica A. Massiah-Jackson issued an order July 30 denying the city’s motion for summary judgment in Watson v. Families Forward. The city is also a defendant in the case, and argued it was immune under the Tort Claims Act.
