The state Supreme Court has agreed to take up an appeal challenging the Superior Court’s decision that struck down as unconstitutional the mandatory minimum sentencing scheme for those convicted of crimes against children.

The justices on Wednesday agreed to hear arguments in Commonwealth v. Wolfe over whether the Superior Court’s decision striking the 10-year mandatory sentence for those convicted of involuntary deviate sexual intercourse with a person younger than 16 was erroneous as a matter of law. The court granted an expedited appeal in the case, and listed argument for the court’s November session.
