Precise details of a man’s final working day are not required to prove a causal connection between his job and the heart attack that killed him, the Commonwealth Court has ruled.
The court, in an unreported Aug. 14 opinion, reversed the Workers’ Compensation Appeal Board, ordering that fatal claim benefits be granted to Judith Dietz, whose husband died while working as a field maintenance worker for the Lower Bucks County Joint Municipal Authority. The WCAB had denied the claim because there was no evidence of Robert Dietz’s work activities on the day of his heart attack.
