The state Supreme Court has agreed to hear arguments over whether a court should be able to expunge the criminal record of a woman who pleaded guilty to criminal charges in consecutive years more than 15 years ago.
The justices granted allocatur in Commonwealth v. Giulian earlier this month on the issue of first impression. In its one-page per curiam order, the court granted argument on the issue of whether defendant Victoria C. Giulian should have been eligible to have her summary convictions expunged since she has been free of arrests and prosecution for more than 16 years, which is more than 10 years longer than 18 Pa. C.S.A. Section 9122(b)(3) requires.
