Unpaid disciplinary suspension is not a type of leave for which a person can purchase credit under the State Employees’ Retirement Code, the Commonwealth Court has ruled in a case of first impression.
A unanimous three-judge panel of the court held Oct. 23 that because a former employee of the Pennsylvania State Police did not receive a salary, did not perform any services, made no contributions toward his retirement and received no employer contributions during his suspension, he could not be credited service.
