The MCARE Act’s statute of repose has barred claims in four cases against a doctor who allegedly placed unnecessary stents in patients, a common pleas judge has ruled. The decision came despite the plaintiffs being unaware of the alleged misconduct until years after it took place.
Philadelphia Court of Common Pleas Judge Frederica Massiah-Jackson late last month granted judgment on the pleadings and tossed claims in four cases lodged against cardiologist Vidya Sagar Banka because the suits had not been brought soon enough under the Medical Care Availability and Reduction of Error Act.
