A federal judge has denied a request for summary judgment from H.J. Heinz Co.’s insurer claiming the food company wasn’t fully transparent about a series of contaminations in its products.

Starr Surplus Lines Insurance Co.’s motion for rescission of Heinz’s policy came by way of a counterclaim to Heinz’s breach of contract suit against the company for refusing to pay coverage stemming from losses incurred from accidentally contaminated foods.
