The federal judge overseeing the Zoloft multidistrict litigation in the Eastern District of Pennsylvania has remanded to Missouri state court a single case involving 40 plaintiffs from 29 states, punting on the issue of whether a state court could hear claims by non-residents against out-of-state defendants.
The case of R.J. v. Pfizer was initially filed in Missouri state court but defendants Pfizer and Greenstone LLC removed it to federal court in that state. It was ultimately transferred to become part of the MDL. The plaintiffs then sought to remand the case back to state court because Pfizer and four of the plaintiffs were from New York, destroying complete diversity of citizenship, U.S. District Judge Cynthia Rufe of the Eastern District of Pennsylvania said in her order Wednesday remanding the suit.
