Breach of Contract • Early Retirement Benefits • Exhaustion of Administrative Remedies
Walters v. Stroudsburg Area Sch. Dist. Bd. of Educ., PICS Case No. 15-1826 (C.P. Monroe July 30, 2015) Zulick, J. (10 pages).
In this breach of contract action alleging failure to award early retirement incentives, because defendant-board of education failed to give plaintiffs opportunity for a hearing, proper remedy was to remand for further proceedings, including reasonable notice and an opportunity to be heard. Defendant's failure-to-exhaust-administrative-remedies preliminary objection was granted, its adjudication of plaintiffs' claims vacated and the matter remanded for further proceedings.
