A motion to recuse Montgomery County’s entire common pleas bench based on one judge’s financial interest in the case at hand has divided an en banc panel of the Pennsylvania Superior Court.

An equally divided eight-judge en banc panel of the court affirmed the damages verdict in Lomas v. Kravitz, while all eight agreed to affirm the liability verdict. The four who argued to affirm the damages said the defendants’ recusal motion was untimely filed, and “a baseless attack” on the trial court after learning the liability verdict.
