The state Supreme Court has relisted labor union leader John Dougherty’s previously dismissed appeal in a defamation suit, reviving a case that has come to involve recusals, campaign donations, quorum issues and the court’s new complement of justices.

Dougherty, the head of the International Brotherhood of Electrical Workers, Local 98, petitioned the court last year to revive his appeal in Dougherty v. Heller, arguing the court violated its quorum rules when only two justicesChief Justice Thomas G. Saylor and Justice J. Michael Eakindecided to remove the case from the oral argument schedule and dismiss the appeal as having been improvidently granted.
