Pennsylvania Attorney General Kathleen Kane has asked a court to stay a civil action filed against her by a former deputy, arguing the case could overlap with criminal charges that might still be filed against Kane.
In a motion to stay Barker v. Kane, Kane’s lawyers said plaintiff James Barker alleged he was fired for testifying before a grand jury that ultimately recommended criminal charges against Kane. Those criminal charges, including perjury and obstruction, were filed in Montgomery County, where the same grand jury later recommended the district attorney there look into whether Kane’s firing of Barker violated a protective order put in place by the grand jury supervising judge.
