Pittsburgh police officers must be city residents, the Commonwealth Court has held, ruling that an interest arbitration award cannot modify a collective bargaining agreement in contravention of state law.

A deeply divided en banc panel of the court held Jan. 7 in City of Pittsburgh v. Fraternal Order of Police, Fort Pitt Lodge No. 1 that an arbitration panel exceeded its authority by allowing the Fraternal Order of Police to bargain over a residency requirement in violation of both the Civil Service Act and the Pittsburgh Home Rule Charter.
