A defendant doctor facing a wrongful-death action can take a supplemental deposition of a coroner who conducted an autopsy of the decedent, a Lackawanna County judge has ruled.
The defense should be allowed to depose the coroner because autopsy photos unavailable at the time of his deposition have since been secured, Judge Terrence R. Nealon wrote in the Jan. 13 opinion in Coleman v. Huang. Preventing a supplemental deposition could present surprises at trial, he said.
