The city of Philadelphia cannot modify the operations of Girard College to suspend its residential and high school programs, the Commonwealth Court has ruled.

In a unanimous en banc decision, the court held that the city lacked the foundation to support its contention that the modifications are necessary to preserve the school into the future. The city brought the appeal through the Board of Directors of City Trusts, claiming that the Stephen Girard trust is in a declining financial state.
