State Attorney General Kathleen Kane and her chief of staff have asked a federal district court to dismiss the civil case brought against them by two special agents from her office, arguing that the grand jury testimony behind their retaliation claims was not protected speech.
Attorneys for Kane and Jonathan Duecker, her chief of staff, filed motions Jan. 29 in the U.S. District Court for the Middle District of Pennsylvania, seeking to dismiss the suit brought by special agents Michael Carlson and Michael J. Cranga. In nearly identical briefs in support of their motions, they said Carlson and Cranga acted insubordinately when they testified before a grand jury about a shuttered Office of Attorney General investigation.
