As the Pennsylvania Senate prepared to vote Wednesday on state Attorney General Kathleen Kane’s removal and the state House of Representatives prepared to vote on whether to launch impeachment proceedings, a filing in Justice J. Michael Eakin’s disciplinary case said Kane failed to comply with a subpoena from the Court of Judicial Discipline.
In a document dated Feb. 1, which the CJD made public Monday, lawyers for the Judicial Conduct Board said Kane ignored the court’s request for all offensive emails on Office of Attorney General servers that Eakin sent or received with government equipment since 2008. Kane’s office acknowledged receipt of the subpoena on Dec. 17, 2015, but has not complied, the board said. The subpoena requested delivery of the emails by Jan. 10.
