A former Penn State administrator facing criminal charges over his handling of sex-abuse allegations is seeking to preserve a possible legal malpractice suit against the university’s former in-house attorney who became central to the prosecution against him.
Gary Schultz, former Penn State senior vice president for business and finance, recently filed an objection to the termination of a potential suit he filed against Cynthia Baldwin, who was counsel for Penn State from 2010 until mid-2012 and appeared with Schultz before a grand jury investigating convicted child molester Jerry Sandusky. Schultz’s objection was filed by Thomas A. Sprague of Sprague & Sprague on Feb. 19, but was docketed with the Centre County Court of Common Pleas on Tuesday. Schultz was charged in 2011 with perjury, failure to report suspected child abuse, endangering the welfare of children, obstruction and conspiracy; however, several charges were recently tossed out by the state Superior Court due in large part to Baldwin’s handling of the grand jury investigations.
