A jury should determine whether a plumbing supply business was negligent in its supervision of an employee who lured a child into his company car, a Lackawanna County judge has ruled. The judge also dismissed the company from a claim for punitive damages that had been filed against both it and the employee.

In a Feb. 19 opinion, Lackawanna County Court of Common Pleas Judge Terrence R. Nealon held that issues of fact exist regarding the company’s supervision of Peter Cruciani, a registered sexual offender who allegedly entrapped a co-worker’s daughter in his car and allegedly had indecent contact with her. But there was not sufficient evidence to show that Mid-Valley Plumbing Supply Inc. engaged in the intentional conduct necessary to support a claim for punitive damages against the company, Nealon said.
